December 4, 2009 – Wisconsin – To celebrate his 54th birthday last April 23, medical marijuana advocate Gary Storck began lobbying for the Jacki Rickert Medical Marijuana Act at the state Capital with his friend Mary Powers, a wheelchair-bound U.S. Army veteran who was fighting AIDS, Hepatitis C and several forms of cancer.

“By the summer’s end we were there weekly, and I would make a short movie each week, just a couple minutes, ‘The Mary and Gary Show’,” Storck said. “There are seven on YouTube. Mary and I hit more than 80 offices, and soon other patients joined us. Mary was often having a hard time, but she was always there waiting for me in the rotunda on lobby days. She became a familiar figure in the hallways and offices.”

Mary’s last day of lobbying was Oct. 7.

“She was using an oxygen tank,” Storck said. “I took her into (Senate Republican leader) Scott Fitzgerald’s office to show them the face of medical marijuana, after his spokesperson, Kimber Leidl, issued statements saying ‘the risks outweighed the benefits’.”

Mary Powers died in her sleep Oct. 22.

“It devastated our tight little group. Jacki (Rickert), myself and others had spoken to Mary every day,” Storck said. “We are grieving, but we know Mary is with us, and her efforts have inspired many more to pick up this cause. Her suffering was too great, and we are glad she is free. Mary was also the founder of Wisconsin Veterans for Medical Marijuana Access, and we are trying to carry on her work with another veteran.”

Storck discovered the medicinal benefits of marijuana by accident in 1972 when it relieved his congenital glaucoma. He was inspired to fight for medical marijuana in 1997 when a staph infection after his third open heart surgery almost killed him.

“As a doctor was removing the staples from the wound left in my groin by the heart lung pump, she infected me with staph,” he said. “48 hours later I was
deathly ill. I went to the ER and right into surgery. They took a lot of infected tissue out of my right groin. What followed were the worst 2 weeks of my life. I had several more surgeries, including removal of a 32-square-inch skin graft off my thigh to cover the hole in my groin. I was on the strongest antibiotics and a morphine drip. I believed I would die there in that hospital.”

On the ninth day on what he thought was his deathbed, Storck said he was visited by a “cannabis angel” with an edible. The cannabis angel returned the next day.

“By the third day, I was able to go outside and smoke a joint. And it was the best joint ever, because I knew I was going to make it out alive!” Storck said.

“And I vowed that day that I would use this extra time I was given to see that medical cannabis was finally legal in Wisconsin. It’s looking like, with a little luck and the blessings of the cannabis angels, that those efforts will soon come to fruition. But, there is still a lot of work yet, and the people of Wisconsin need to make their 80% support heard. But from a very long view, we are very close to the Promised Land.”

KEY POINTS OF THE JACKI RICKERT MEDICAL MARIJUANA ACT

The Act allows three categories of medical marijuana users:

1) cancer, glaucoma, AIDS, a positive HIV test, Crohn’s disease, a Hepatitis C virus infection, Alzheimer’s disease, Amytrophic Lateral Sclerosis, nail patella syndrome,

Ehlers-Danlos Syndrome, post-traumatic stress disorder, or the treatment of these conditions;

2) a chronic or debilitating disease or medical condition, or the treatment of such a disease or condition, that causes wasting away, severe pain, severe nausea, seizures, or severe and persistent muscle spasms;

3) any other medical condition or treatment for a medical condition designated as a debilitating medical condition or treatment in rules promulgated by the Department of Health Services.

A qualifying patient may invoke the medical necessity defense if he or she acquires, possesses, cultivates, transports, or uses marijuana to alleviate the symptoms or effects of his or her debilitating medical condition or treatment.

Maximum authorized amount of marijuana: 12 marijuana plants and three ounces – approximately 85 grams – of marijuana leaves or flowers.

The bill requires DHS to establish a registry for medical users of marijuana. A person claiming to be a qualifying patient may apply for a registry identification card by submitting a signed application, accompanied by a written certification and a registration fee of not more than $150. Source.

November 12, 2009 – The U.S. Justice Dept., at the direction of the Obama Administration, last month announced that it would no longer direct federal investigative resources to pursue criminal charges against Picture 2medical marijuana clinics, providing they are operating lawfully. The policy represents a major shift in tactics from the Bush Administration, which had federal agents raiding medical marijuana distributors on the basis of violating federal statutes (federal law outlaws marijuana possession under the Controlled Substances Act) — even if the operators were in compliance with state laws.

Will the new Obama policy kick off an entrepreneurial bonanza in the 13 states (Alaska, California, Colorado, Hawaii, Maine, Michigan, Montana, Nevada, New Mexico, Oregon, Rhode Island, Vermont, and Washington) where medical cannabis is legal? Maybe, experts say, citing the proliferation of medical marijuana training centers in recent years and a plan by one California business to begin franchising the dispensaries. But while the potential for a large medical marijuana market exists, cannabis remains mired in legal ambiguities and political sensitivities that — while changing rapidly — are still difficult for entrepreneurs to navigate.

To start, most of the 13 states do not allow storefront dispensaries; they permit medical patients to grow their own marijuana or purchase it directly from a registered grower certified by the state. In the rare places that do allow dispensaries, they must be structured as nonprofit cooperatives rather than for-profit entities, with marijuana provided by state-certified patients or their caregivers.

Neighborhood nuisance
In California, the first state to legalize medical marijuana sales and use in 1996, this nonprofit requirement came in mid-2008, when State Attorney General Jerry Brown issued guidelines for medical marijuana operations to try to rein in the hundreds — if not thousands — of for-profit dispensaries that had cropped up, many turning into neighborhood nuisances, with doctors on staff who would write prescriptions for anyone who walked through the doors. (California’s guidelines stating they should be nonprofit aren’t law; they’re in an opinion issued by Brown.)

Now the epicenter of the regulated medical marijuana movement is in Oakland, Calif., where four licensed cannabis dispensaries operate under strict city and state guidelines. This summer, the city’s voters approved by 80 percent a special 1.8 percent sales tax on marijuana sales that will go directly into the city’s general fund, says Steve DeAngelo, the founder of nonprofit dispensary Harborside Health Center. He and his attorney, James Anthony, devised the idea of the special tax while discussing the city’s financial straits.

Harborside, which looks something like a tidy community bank, does $20 million in annual sales, has 30,000 registered patients in its collective, and 75 full-time employees, DeAngelo says. His product is tested for purity and potency at a laboratory he helped found, he says, adding that during the past year’s recession his staff grew from 43 to 75, and says he pays each a living wage, provides them with health insurance and paid leave, and has recently added a pension program.

A lifelong cannabis activist and entrepreneur, DeAngelo has also come up with a new business idea. He recently founded for-profit Harborside Management Associates, a firm that currently does consulting for cannabis dispensaries and hopes to become America’s first franchised medical marijuana operation.

College course
Also located in Oakland is Oaksterdam University, a non-accredited private educational facility that teaches would-be dispensary owners to operate their own medical marijuana clinics. About 6,000 students have gone through its certificate program, which meets two hours a week for 13 weeks, says Greg Grimala, an Oaksterdam spokesperson.

While there is no requirement for dispensary operators to be certified, education and training may help entrepreneurs gain local approval for the facilities. “It’s very, very important for people who want to open dispensaries to work with their local government,” Grimala says. “It’s the local government that’s going to dictate whether they want to have this business in their neighborhood. If you open up in a city that does not want you there, they’ll find a way to force you out.”

Capital requirements for a new dispensary are $80,000 to $100,000 minimum, Grimala says. Richard Lee, who founded Oaksterdam University, agrees. He operates the Coffee Shop Blue Sky in Oakland, a combination for-profit coffee shop and for-profit medical marijuana dispensary that he says brings in $3 million in annual revenue. (Oakland’s local ordinance calls for no “excessive” profit, and Lee says so far the city has not deemed his dispensary to be making excessive profits.)

DeAngelo says he advises clients to plan on $250,000 in startup costs for larger operations like his own at Harborside. Along with purchasing marijuana plants and supplies, doing testing, staffing the facility, and providing adequate security, local jurisdictions often impose fees for licensing or conditional use permits, he says.

No cash cow
“If you think this is the newest way to make lots of money, I’d say get into another business,” DeAngelo says. “Even if you’re wildly successful and make a lot of money, you’re going to have to give that back to the community” because of the nonprofit business model, which he supports for the future.

“This is an opportunity for social entrepreneurs, who are willing to help suffering people feel better and expand the zone of freedom in our country. The type of person who should get into this business will be looking for less tangible rewards,” he says.

Bruce Mirken, communications director of the Marijuana Policy Project, a lobbying and educational organization that advocates legalizing, regulating, and taxing marijuana, says that even in the states with the most liberal laws, storefront dispensaries exist in something of a gray area. While federal enforcement conflicted with state law, many cities were reluctant to issue formal guidelines for dispensaries, leaving the operators in legal limbo, he says. “Things will continue to evolve, and my guess is that more states will be open in time, but that’s anybody’s guess,” Mirken says.

Still, in the past several years, model dispensaries and industry best practices have begun to emerge. The Medical Cannabis Safety Council, in conjunction with other medical cannabis policy groups, is attempting to establish a self-regulatory model built on non-profit industries such as hospital emergency rooms, says Mickey Martin, a founding project adviser for the group and associate editor for West Coast Cannabis Magazine.

Ballot initiative
DeAngelo says he is optimistic about his company’s fortunes. “I believe the Obama Administration is being honest with us when they say we won’t be raided by the federal government if we’re in scrupulous compliance with state law and local regulations,” he says. He and other activists are collecting signatures to place a marijuana legalization initiative on the California ballot next year.

Tax Cannabis 2010 would allow cities and counties throughout the state to tax and regulate marijuana for adult use. “We think it will bring our laws in line with reality,” Grimala says. Even if that initiative is approved by voters — and it is certain to draw fierce opposition — DeAngelo says he will push for the industry to remain not-for-profit. “The country should get it right this time. Let’s take care of our cities and our schools and not give this one to the multinational corporations,” he says.

While he favors allowing adult recreational use, he says he is horrified by the idea of children being exposed to over-the-counter marijuana sales. “Do we want kids to walk into 7-Eleven past cigarettes and booze — and marijuana also? Do we want them to open up Rolling Stone and see a two-page glossy spread for reefers?”

October 12, 2009 – Californians have made it clear at the ballot box that they favor legalizing marijuana use for medical purposes. But, as critics feared, Prop. 215, the medical marijuana initiative that was passed 13 cali_pot_0311years ago, has only opened the door to abuse.

It’s estimated that there are 40 marijuana dispensaries in Long Beach and 800 or more in Los Angeles alone. L.A. County District Attorney Steve Cooley decided last week that most of them are operating illegally, and wants to shut them down.

That may be too harsh. As supporters of medical marijuana rightly contend, closing all dispensaries would punish people who are entitled to marijuana.

Prop. 215 and the state law permitting collective cultivation of marijuana were meant to help chemotherapy and others suffering from pain or nausea to obtain marijuana with a doctor’s recommendation. An actual prescription wasn’t needed. Given an opening, marijuana dispensaries cropped up everywhere, providing a safe, although apparently illegal, way for just about everyone to obtain the drug at competitive prices.

There is a better way to regulate marijuana. For starters, people who really need and want marijuana for their medical conditions should get a prescription — from a doctor — and fill the prescription at a pharmacy, just as they would obtain any medication. The whole process must be confidential. Keeping a list of medical marijuana users is unjust and unnecessary.

The next step would be to bow to the will of Californians, who generally favor decriminalizing marijuana use. It’s estimated that California is losing tens of millions of dollars from illegal marijuana sales — revenue it could collect if marijuana sales were legal. Once it’s legal, of course, prescriptions would not be necessary, and dispensaries could be tightly regulated, similar to the way liquor stores are regulated. Age limits, proximity of dispensaries to schools and residential areas would have to be regulated and enforced. Just as liquor can’t be sold without a license, street sales would be illegal.

Legalizing marijuana would go a long way toward reducing trafficking, which has turned Mexican border cities into horrific battlegrounds as drug cartels fight each other and the police, many of whom are so corrupt as to make regulation farcical.

If America learned anything from Prohibition, it’s that criminalizing a substance people want will only drive them to get it illegally. That lesson applies to marijuana. Legalize it. Regulate it. And enforce the regulations. The time has come. Source.

July 10, 2009-The legalization of marijuana has been a controversial topic for many years now. It remains to be illegal in much of the country, but Drug War Rethinking PotCalifornia is one state in which it is legal for medical purposes, as long as patients have a note signed from their doctor and buy the marijuana from a dispensary that is regulated. But this is upsetting to some government officials, including the federal government who regularly raid the dispensaries, and some local government officials who say 800 dispensaries in one city is too many. One city council member said that a dispensary near a high school looked “like an ice cream shop from the 1950s” with the amount of teenaged kids crowded around it.

Maybe a high school isn’t the place for a dispensary or any other avenue to sell drugs, but the use of marijuana by responsible adults should not be a criminal activity. Medical marijuana can be used as a viable treatment for cancer, Glaucoma, Depression, PMS, lack of appetite, Crohn’s Disease, migraines, Fibromyalgia, Multiple Sclerosis, Tourette’s syndrome, Obsessive-Compulsive Disorder, Alcoholism, Attention Deficit Disorder, Lou Gehrig’s disease, Rheumatoid Arthritis, Autism, Bipolar Disorder, Hypertension, morning sickness (though no one will endorse the smoking of marijuana, or any other substance, by pregnant women), Post-Traumatic Stress Disorder, staph infections, Sickle Cell Anemia, Parkinson’s, and Sleep Apnea (snoring). Many more without a medical condition that would warrant their doctor to write a note specifying a need for the drug, feel that marijuana relaxes them after a hard day at work and one dispensary even set up a movie theatre in the shop where the patients could unwind and meet new people. There is even a dispensary selling marijuana online on social marketing websites like Twitter and Facebook that will deliver the drug free to Los Angeles residents who may not want to venture outside.

Marijuana is a relatively harmless drug and one that is a lifesaver to the many people who use it in its proper form. While there is always potential for abuse, alcohol used in an irresponsible way, as many people in the United States use it, is more harmful than marijuana used by responsible adults. Barney Frank and Ron Paul introduced legislation earlier this summer to legalize small amount of marijuana by adults, whether they would like to use it for medical or recreational purposes, and hopefully it will start to put an end to the billions that we spend on the drug war each year and the lives and businesses lost in the process of government nannyism. THE drug war policy wonks are in retreat. The UN’s World Drug Report makes this clear.

Released last month in Washington by the head of the UN Office on Drugs and war-on-drugsCrime, with new US government drug tsar Gil Kerlikowske, the report has direct implications for all countries.

The report reveals that a significant shift is occurring in the way the world controls drugs. The ambition of ending drug use through law enforcement is giving way to a sobering realisation that we need to reduce demand for drugs, decrease incarceration of drug users and increase drug treatment programs.

The report warns against using law enforcement as a blunt instrument and calls for “universal access to drug treatment to save lives and reduce demand”. Kerlikowske, newly appointed head of the White House Office of National Drug Control Policy, has recently said we should “completely and forever end the war analogy, the war on drugs”. Based on 100-year-old policy architecture, it has failed to eradicate the illicit drug trade, conservatively estimated to be worth more than $320 billion a year.

As a result, we are confronted with regional and national HIV epidemics driven by illicit injecting drug use. The UNODC report records injecting drug use in 148 countries, covering 95 per cent of the world’s population.

Just as we live in a global economy, so we live in a global illicit economy. While Australia doesn’t have the crack cocaine problems found in the US or Britain, it does have different drug problems, particularly with opiates and amphetamines.

In Australia, we had a clever government approach to drugs. Officially called Tough on Drugs, tabloid-style drug war rhetoric was matched with investment in treatment programs. The government sensibly invested resources in the diversion of drug users away from the criminal justice system and into the drug treatment system.

The public machismo of drug war rhetoric was matched with the quiet national funding of evidence-based and sensible interventions, such as opioid substitution treatments and needle and syringe programs.

Australia’s Howard government spending was built on a solid policy foundation. Since 1985 Australia has relied on a strategy with three key elements to address illicit drugs: demand reduction, supply reduction and interventions to reduce the harm when drug use does occur, commonly known as harm reduction.

A Howard government-funded study showed that during a decade harm reduction programs significantly reduced the need for health services, saving $7.7 million. Here lies the reason the Howard government’s investment in harm reduction, based on needle and syringe programs, existed under the banner of Tough on Drugs.

While a drug strategy based on supply, demand and harm reduction sounds balanced, the devil is in the detail. Nearly 50 per cent of all drug strategy funding is still spent on law enforcement and only 3 per cent on harm reduction. Most of the demand and harm reduction budget for drugs is dispersed through the Council of Australian Governments’ new National Health Care Agreement. The quantum of money to health generally has increased to record high levels under the Rudd government, to be dispersed by the states and territories under broad agreements with the federal government.

The problem with these new agreements is they do not have key performance indicators for demand and harm reduction programs or for communicable diseases such as HIV. They also do not insist that specific funds be attributed to programs that meet nationally agreed targets for our illicit drugs strategy.

The risk to our drug control efforts is therefore twofold: John Howard didn’t have the spending balance right between supply, demand and harm reduction, and specific accountabilities are not enshrined in the new healthcare agreements.

There is little political glory in funding drug addiction services and HIV prevention.

Weak political constituencies in these areas make funding a constant vulnerability. This encourages state treasuries to take a reactive approach to spending, moving further away from funding the drugs area proactively andadequately, pending another HIV or drug crisis.

At the local level, police and drug treatment and social welfare programs will often work together to reduce harm associated with drug use. However, the lack of key performance indicators in healthcare agreements, poor access to training and workforce development, and high levels of workforce attrition mean that cross disciplinary collaboration on a long-term basis is at risk.
