June 30th, 2009 – Those of us who have seen the suffering of sick friends or family members relieved by smoking marijuana remain mystified at Gov. M. Jodi Rell’s opposition to a medical marijuana law. But perhaps she will be inspired by Rhode Island’sGeriatrics_patient example.

The Ocean State’s legislature has expanded a 2006 medical marijuana law to allow for state-licensed “compassion centers,” dispensaries where chronically ill residents who are registered with the state health department and have a prescription from a doctor may buy pot to ease their pain. There are 700 registered patients and 582 caregivers who may purchase marijuana on behalf of someone else.

Rhode Island joined California and New Mexico as the only states to permit marijuana sales to chronically ill people. At least eight other states, including New Hampshire and Maine, are considering similar legislation; 13 states offer some legal protection to patients who use marijuana under a doctor’s care.

Connecticut might have been the 14th. A bill introduced last year would have allowed patients with conditions such as cancer, epilepsy, glaucoma, multiple sclerosis or AIDS to grow up to four marijuana plants in their homes with a doctor’s prescription. The bill was approved by wide margins in the Connecticut House and Senate. Polls showed that 83 percent of residents supported the legislation.

But Mrs. Rell vetoed the measure. She said it would force people to seek out drug dealers to buy marijuana, apparently unaware that that’s what sick people or their friends were already doing.

Mrs. Rell also said the bill would send the wrong message to young people. But research by the Washington, D.C.-based Medical Marijuana Project has found no increases in marijuana use among the young and some indications of less use in some age groups in states that allow medical marijuana.

Perhaps when pot becomes a palliative for cancer or HIV/AIDS patients, it loses its attraction.

State Rep. Penny Bacchiochi, R-Somers, whose then-husband used marijuana to counter the pain of bone cancer in the 1980s, reintroduced the medical marijuana bill earlier this year but did not press it after she was told that the governor had not changed her position.

The governor ought to do so in time for the 2010 session, lest she allow ideology to trump compassion. Source.

The Rhode Island legislature overrode a gubernatorial veto of a medical marijuana law Tuesday afternoon by an overwhelming margin, paving the way for state-licensed medical marijuana shops to begin operating. The House voted 68-0 for the pot measure and the senate moved it minutes later by a 35-3 count.

Once the law takes effect, the state will be the first in the nation to have one officially licensed nonprofit center selling marijuana. Over time, the state will license further nonprofit dispensaries.

The bill got a boost in the state after a much publicized incident in which a pot dealer beat up a medical marijuana patient. Proponents of the bill argued that patients shouldn’t have to deal with unregulated, unlicensed drug dealers, but deserved a more orderly system.

In March, New Mexico became the first state to grant a state license to a medical marijuana producer.

“We are seeing a historic shift to allowing state-licensed, regulated medical marijuana production and distribution,” said Karen O’Keefe of the Marijuana Policy Project after the vote.

Legislators in Delaware, Illinois, Iowa, New Hampshire, New Jersey, North Carolina and Pennsylvania are considering similar legislation. Arizona and Maine voters may soon vote on similar initiatives.

The Rhode Island bill’s passage was only made possible by President Obama’s announcement that his Justice Department would not raid medical marijuana dispensaries in states where they were following the law.

California’s dispensaries operate legally in the state but don’t have the kind of exclusive state license that the new Rhode Island shop will have.

Jesse Stout, executive director of the Rhode Island Patient Advocacy Coalition, which led the charge on the bill, said that state Rep. Tom Slater’s announcement Saturday that he would himself begin using medical marijuana to treat his rapidly advancing cancer swayed the General Assembly. Slater, a Democrat, is the bill’s sponsor.

The Rhode Island Department of Health will license one nonprofit “compassion center” in 2010 and two more in 2011. They will grow and distribute marijuana and provide it to an unlimited number of patients.

Rhode Island became the third state in the country Tuesday to allow the sale of marijuana for medical purposes.

The House and Senate easily overrode Governor Carcieri’s veto of bills that would permit up to three dispensaries that advocates have dubbed “compassion centers.”

In 2006, the General Assembly permanently legalized the use of medical marijuana. Doctors could prescribe it for critically ill patients. But there was no legal way to buy the drug, leaving patients or their caregivers to grow it, or buy it on the street.

“For the more than 600 Rhode Islanders who rely on medical marijuana to help relieve the unimaginable suffering that some diseases cause, or to relieve their nausea enough to take food, this will provide not only relief and safety, but also dignity,” said Rep. Thomas C. Slater, who sponsored the bill in the House and is himself battling advanced cancer.

“Sick people should not be forced to associate with drug dealers and the dark underbelly of society to get the help they need. I’m glad we’re finally recognizing their right to access marijuana safely, legally and without needless shame or fear,” said Slater, a Providence Democrat.

In late May, the House approved Slater’s bill by a 63-to-5 vote. An identical bill sponsored by Sen. Rhoda E. Perry passed the Senate on June 9 by a vote of 31 to 2. Although both votes indicated a veto-proof majority, Governor Carcieri vetoed them on June 12, saying “the increased availability, along with a complacent attitude, will no doubt result in increased usage, and will negatively impact the children of Rhode Island.” He also said the dispensaries would complicate the jobs of law enforcement officers and create a perception that Rhode Island is complacent against illegal drugs.

“We still have our same concerns,” Carcieri spokeswoman Amy Kempe said after Tuesday’s overrides. “The administration believes there are a lot of issues that should be looked at legislatively before we proceed.”

She cited concerns for the safety of patients who will use compassion centers. “They’re easy targets, walking out with medicinal marijuana –– two blocks later they’re being mugged.”

California has compassion centers where patients with a prescription can buy marijuana legally, but those dispensaries were not created by legislation and are not regulated. Earlier this year, New Mexico became the only state to license nonprofit producers of medical marijuana.

At least one national marijuana advocacy group hailed Rhode Island’s veto override as historic. “Now that the Obama administration has announced a policy change,” said Aaron Houston, director of government relations for the Marijuana Policy Project, “state legislators seem to feel safer adopting a sensible, regulated system of medical marijuana distribution that avoids the mistakes of California, where dispensaries sprang up with no rules. This is a historic step forward.”

States now considering creation of state-licensed dispensaries include Delaware, Illinois, Iowa, New Hampshire, New Jersey, North Carolina and Pennsylvania, and a ballot initiative is being circulated in Arizona, according to the Marijuana Policy Project. This November, Maine voters will consider a ballot initiative to add dispensaries to the state’s medical marijuana law.

After Tuesday’s vote — the first override of the year — Slater assured his colleagues the forthcoming centers will be monitored. “I know many of you had hesitation over this bill, but I can assure you we will have consistent oversight so nothing goes wrong.”

June 14, 2009 – Medical marijuana patients in Rhode Island are on the verge of having safe access to their medicine legally under state law. The House and Senate have each images-7overwhelmingly passed the twin bills to allow the non-profit distribution of medical marijuana, with the Senate most recently approving the House bill in a 31-2 vote on June 9. This incredible legislative support has been heartwarming, and we are on the cusp of giving the state’s more than 600 medical marijuana patients safe and consistent access to the medicine they need!

H. 5359 and S. 0185 have been transmitted to Governor Donald Carcieri (R). He has until next Tuesday, June 16 to sign the bill, veto it, or allow it to become law without his signature. Unfortunately, given the governor’s history of vetoing compassionate medical marijuana bills in the past, we expect him to thwart the will of the people and the legislature and veto the bill. Then, we are hopeful both chambers will vote to override the governor’s veto. In order to do so, 60% of each chamber must vote for the legislation. Our compassion centers legislation has consistently garnered over 90% support in both chambers this year, and we are excited for these last historic voting opportunities.

After one of the votes, Representative Thomas C. Slater (D-Providence), H. 5359’s sponsor, commented, “We recognized when we created the medical marijuana program that marijuana has a legitimate medical application, and that patients should have access to it if they need it. But we forced them to deal with criminals in order to get it. We’re talking about very sick people, and they shouldn’t have to put themselves at risk to get their medicine.” This is a personal issue for Representative Slater, as he has been diagnosed with two types of cancer and is currently undergoing treatment. He is one of four of the six siblings in his family with the disease, and lost his father, brother, and uncle to cancer. The Providence Journal recently did a very moving profile of him and his years of fighting on behalf of seriously ill patients and other disadvantaged Rhode Island residents. Source.

June 10th, 2009 – PROVIDENCE, R.I. (AP) — Rhode Island would be the third state in the nation and the first on the East Coast to allow nonprofit stores to sell marijuana to medical patients under legislation approved Tuesday by state lawmakers.images-3

The state Senate voted 30-2 to adopt a measure permitting three stores to sell marijuana to more than 680 patients registered with the state Department of Health. It now heads to Gov. Don Carcieri, who has previously vetoed bills legalizing marijuana for medical use.

Since 2006, Rhode Island patients suffering from conditions including chronic pain, severe nausea, seizures, multiple sclerosis or Alzheimer’s disease have been able to possess up to 12 marijuana plants and 2.5 ounces of the drug in a usable form. But buying marijuana remains illegal under state law, creating difficulties for patients who tried to obtain the drug.

“The Rhode Island Statehouse is on the cutting edge of helping people with severe health care problems,” said Sen. Rhoda Perry, D-Providence, who sponsored the Senate bill. “Now patients will not be subjecting themselves to any harassment because we will have a well-regulated mechanism that will grow and distribute the marijuana.”

Twelve other states allow for the medicinal use of marijuana, but Rhode Island would become only the third — after California and New Mexico — to create dispensaries.

“I think what will happen, assuming that programs work smoothly, is that other states will follow the example,” said Bruce Mirken, spokesman for the Marijuana Policy Project, a national advocacy group in Washington. “As a couple of states do it and the sky doesn’t fall, we’ll see more of them move in that direction.”

Carcieri spokeswoman Amy Kempe said she could not comment on whether Carcieri would veto the measure, but the governor has larger concerns about weakening controlled substance laws and how to regulate the three “compassion centers.”

The legislation has passed the House and Senate by veto-proof margins, with more than the 60 percent of lawmakers needed to overturn a veto.

The Rhode Island State Police have also voiced opposition to the measure, saying that authorities found California dispensaries to be drug trafficking organizations and fronts for organized crime.

George DesRoches, a Cranston native who smokes marijuana for chronic pain and fibromyalgia, said he’s been held at gunpoint multiple times when trying to obtain the drug. DesRoches also said he’s been robbed three times this year of the marijuana plants he grows.

DesRoches said approving dispensaries would help eliminate many of the issues for him and other patients.

“The number one advantage would be safety for all patients and availability for all patients. It’s pretty simple,” said DesRoches, who did not report the incidents to police.

Former President George W. Bush’s administration had targeted California dispensaries, even if they complied with the state’s marijuana law. However, U.S. Attorney General Eric Holder recently announced that President Barack Obama’s administration would not target marijuana dispensers that follow state law.

June 8th, 2009 – I’m on the phone getting a recipe for hashish butter. Not from my dealer but from Lester Grinspoon, a physician and emeritus professor of psychiatry at Harvard Medical School. And not for a party but for my 9-year-old son, who has autism, anxiety and digestive problems, all of which are helped by the analgesic and psychoactive properties of marijuana. I wouldn’t be giving it to my child if I didn’t think it was safe.

I came to marijuana while searching for a safer alternative to the powerful antipsychotic drugs, such as Risperdal, that are typically prescribed for children with autism and other behavioral disorders. There have been few studies on the long-term effects of these drugs on a growing child’s brain, and in particular autism, a disorder whose biochemical mechanisms are poorly understood. But there is much documentation of the risks, which has caused the Food and Drug Administration to require the highest-level “black box” warnings of possible side effects that include permanent Parkinson’s disease-like tremors, metabolic disorders and death. A panel of federal drug experts in 2008 urged physicians to use caution when prescribing these medicines to children, as they are the most susceptible to side effects.
We live in Rhode Island, one of more than a dozen states — including California — with medical marijuana laws. That makes giving our son cannabis for a medical condition legal. But we are limited in its use. We cannot take it on a plane on a visit to his grandmother in Minnesota.

Even though we are not breaking the law, I still wonder what my neighbors would think if they knew we were giving our son what most people only think of as an illegal “recreational” drug. Marijuana has always carried that illicit tang of danger — “reefer madness” and foreign drug cartels. But in 1988, Drug Enforcement Administration Judge Francis L. Young, after two years of hearings, deemed marijuana “one of the safest therapeutically active substances known to man. … In strict medical terms, marijuana is far safer than many foods we commonly consume.”

Beyond helping people like my son, the reasons to legalize cannabis on a federal level are manifold. Anecdotal evidence from patients already attests to its pain-relieving properties, and the benefits in quelling chemotherapy-induced nausea and wasting syndrome are well documented. Future studies may find even more important medical uses.

Including marijuana in the war on drugs has only proved foolhardy — and costly. By keeping marijuana illegal and prices high, illicit drug money from the U.S. sustains the murderous narco-traffickers in Mexico and elsewhere. In fact, after seeing how proximity to marijuana growers affected the small Mexican village of Alamos, where my husband spent much of his childhood, I was adamant about never entering into that economy of violence.

Because Rhode Island has no California-like medical marijuana dispensaries, the patient must apply for a medical marijuana license and then find a way to procure the cannabis. We floundered on our own until we finally connected with a local horticultural school graduate who agreed to provide our son’s organic marijuana. But given the seedy underbelly of the illegal drug trade, combined with the current economic collapse, even our grower has to be mindful of not exposing himself to robbery.

Legalizing marijuana not only removes the incentives for this underground economy, it would allow for regulation and taxation of the product, just like cigarettes and alcohol. The potential for abuse is there, as it is with any substance, but toxicology studies have not even been able to establish a lethal dose at typical-use levels. In fact, in 1988, Young of the DEA further stated that “it is estimated that … a smoker would theoretically have to consume … nearly 1,500 pounds of marijuana within about 15 minutes to induce a lethal response.” Nor is it physically addicting, unlike your daily Starbucks, as anyone who has suffered from a caffeine withdrawal headache can attest.

Although it has been demonized for years, marijuana hasn’t been illegal in the U.S. for that long. The cannabis plant became criminalized on a federal level in 1937, largely because of the efforts of one man, Harry Anslinger, commissioner of the then newly formed Bureau of Narcotics, largely through sensationalistic stories of murder and mayhem conducted supposedly under the influence of cannabis. Cannabis was still listed in the U.S. Pharmacopeia, or USP, until 1941 as a household drug useful for treating headaches, depression, menstrual cramps and toothaches, and drug companies worked to develop a stronger strain.

In 1938, a skeptical Fiorello LaGuardia, mayor of New York, appointed a committee to conduct the first in-depth study of marijuana’s actual effects. It found that, despite the government’s fervent claims, marijuana did not cause insanity or act as a gateway drug. It also found no scientific reason for its criminalization. In 1972, President Nixon’s Shafer Commission similarly concluded that cannabis should be re-legalized.

Both recommendations were ignored, and since then billions of dollars have been spent enforcing the ban. Public policy analyst Jon Gettman, author of the 2007 report, “Lost Revenues and Other Costs of Marijuana Laws,” estimated marijuana-related annual costs of law enforcement at $10.7 billion.

I was heartened to hear California Gov. Arnold Schwarzenegger’s recent call for the U.S. to at least look at other nations’ experiences with legalizing marijuana — and to open a debate. And given the real security threats the nation faces, U.S. Atty. Gen. Eric H. Holder Jr.’s announcement that the federal government would no longer conduct raids on legal medicinal marijuana dispensaries was a prudent move. Decriminalizing marijuana is the logical next step.

There have been few studies on the long-term effects of these drugs on a growing child’s brain, and in particular autism, a disorder whose biochemical mechanisms are poorly understood. But there is much documentation of the risks, which has caused the Food and Drug Administration to require the highest-level “black box” warnings of possible side effects that include permanent Parkinson’s disease-like tremors, metabolic disorders and death. A panel of federal drug experts in 2008 urged physicians to use caution when prescribing these medicines to children, as they are the most susceptible to side effects.

We live in Rhode Island, one of more than a dozen states — including California — with medical marijuana laws. That makes giving our son cannabis for a medical condition legal. But we are limited in its use. We cannot take it on a plane on a visit to his grandmother in Minnesota.

Even though we are not breaking the law, I still wonder what my neighbors would think if they knew we were giving our son what most people only think of as an illegal “recreational” drug. Marijuana has always carried that illicit tang of danger — “reefer madness” and foreign drug cartels. But in 1988, Drug Enforcement Administration Judge Francis L. Young, after two years of hearings, deemed marijuana “one of the safest therapeutically active substances known to man. … In strict medical terms, marijuana is far safer than many foods we commonly consume.”

Beyond helping people like my son, the reasons to legalize cannabis on a federal level are manifold. Anecdotal evidence from patients already attests to its pain-relieving properties, and the benefits in quelling chemotherapy-induced nausea and wasting syndrome are well documented. Future studies may find even more important medical uses.

Including marijuana in the war on drugs has only proved foolhardy — and costly. By keeping marijuana illegal and prices high, illicit drug money from the U.S. sustains the murderous narco-traffickers in Mexico and elsewhere. In fact, after seeing how proximity to marijuana growers affected the small Mexican village of Alamos, where my husband spent much of his childhood, I was adamant about never entering into that economy of violence.

Because Rhode Island has no California-like medical marijuana dispensaries, the patient must apply for a medical marijuana license and then find a way to procure the cannabis. We floundered on our own until we finally connected with a local horticultural school graduate who agreed to provide our son’s organic marijuana. But given the seedy underbelly of the illegal drug trade, combined with the current economic collapse, even our grower has to be mindful of not exposing himself to robbery.

Legalizing marijuana not only removes the incentives for this underground economy, it would allow for regulation and taxation of the product, just like cigarettes and alcohol. The potential for abuse is there, as it is with any substance, but toxicology studies have not even been able to establish a lethal dose at typical-use levels. In fact, in 1988, Young of the DEA further stated that “it is estimated that … a smoker would theoretically have to consume … nearly 1,500 pounds of marijuana within about 15 minutes to induce a lethal response.” Nor is it physically addicting, unlike your daily Starbucks, as anyone who has suffered from a caffeine withdrawal headache can attest.

Although it has been demonized for years, marijuana hasn’t been illegal in the U.S. for that long. The cannabis plant became criminalized on a federal level in 1937, largely because of the efforts of one man, Harry Anslinger, commissioner of the then newly formed Bureau of Narcotics, largely through sensationalistic stories of murder and mayhem conducted supposedly under the influence of cannabis. Cannabis was still listed in the U.S. Pharmacopeia, or USP, until 1941 as a household drug useful for treating headaches, depression, menstrual cramps and toothaches, and drug companies worked to develop a stronger strain.

In 1938, a skeptical Fiorello LaGuardia, mayor of New York, appointed a committee to conduct the first in-depth study of marijuana’s actual effects. It found that, despite the government’s fervent claims, marijuana did not cause insanity or act as a gateway drug. It also found no scientific reason for its criminalization. In 1972, President Nixon’s Shafer Commission similarly concluded that cannabis should be re-legalized.

Both recommendations were ignored, and since then billions of dollars have been spent enforcing the ban. Public policy analyst Jon Gettman, author of the 2007 report, “Lost Revenues and Other Costs of Marijuana Laws,” estimated marijuana-related annual costs of law enforcement at $10.7 billion.

I was heartened to hear California Gov. Arnold Schwarzenegger’s recent call for the U.S. to at least look at other nations’ experiences with legalizing marijuana — and to open a debate. And given the real security threats the nation faces, U.S. Atty. Gen. Eric H. Holder Jr.’s announcement that the federal government would no longer conduct raids on legal medicinal marijuana dispensaries was a prudent move. Decriminalizing marijuana is the logical next step.

June 4th, 2009 – PROVIDENCE, R.I. (AP) – The state Senate could soon approve legislation permitting nonprofit stores in Rhode Island to sell marijuana to medical patients.

House lawmakers signed off on a final version of the bill Wednesday, sending it back to a Senate committee which has set a vote for Tuesday. If the legislation is ultimately approved by the full Senate, the bill would then go to Gov. Don Carcieri’s desk.

Carcieri has vetoed bids to expand the state’s medical marijuana program in the past.

The new legislation would allow up to three stores to sell marijuana to more than 680 patients registered with the state Department of Health.

Rhode Island permitted medical patients to possess marijuana for pain relief in 2006, but never legalized the sale of the drug.

May 21, 2009 – PROVIDENCE — Three years after legalizing medical marijuana in Rhode Island, House lawmakers Wednesday easily OK’d a plan to create dispensaries that would sell the drug to patients who use it for medicinal purposes.

“To go through cancer, or to go through a debilitating disease is extremely, extremely hard,” said Rep. Thomas C. Slater, the bill’s sponsor and a cancer patient himself. “One day you might feel great, the next day you may have pain all over your body…This bill gives people a safe haven to get help, to get medical marijuana.”

The Senate in April overwhelmingly approved an identical version of the bill. Now each chamber must pass each other’s version for the bill to receive final approval.

Governor Carcieri, a long-time critic of medical marijuana, is expected to veto the measure once it reaches his desk. But the House approved the legislation in a 63-to-5 vote with 7 members absent –– a margin wide enough to easily override a veto.

House Majority Leader Gordon D. Fox indicated that the leadership will seriously consider that option. “I would hope that [the governor] wouldn’t [veto it], and look at the broader issues raised…,” Fox said. “But if he does I think we have the votes to override and I would advocate doing that.”

High above the House floor Wednesday night, medical marijuana patient Ellen Smith of Scituate, who suffers from chronic pain conditions, craned her neck from her spot in a wheelchair to get a better look as the vote took place. When Speaker William J. Murphy announced the legislation had passed, she clapped wildly, her face awash in relief.

Since medical marijuana was legalized in 2006, many of the almost 600 Rhode Islanders like Smith, who are authorized to use drug to relieve pain from certain debilitating diseases, have noted a major loophole in the law: it provided no clear path for them to obtain marijuana, leaving them to try to grow it themselves, or buy it off the streets.
